Terms & Conditions
Last updated 20 September 2026. These terms form the agreement between you and Tracemarkai for use of the TraceMark AI platform.
1. Who you are contracting with
TraceMark AI is operated by Tracemarkai ("we", "us", "our"). By creating an account, submitting content for analysis, or purchasing a plan, you enter into an agreement with Tracemarkai on these terms. You can reach us at tracemarkai@gmail.com.
2. Acceptance
By accessing or continuing to use the service you confirm that you accept these terms. If you do not accept them, do not use the service. If you are using TraceMark AI on behalf of a school, business or public body, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age in your country.
3. What the service does — and does not do
TraceMark AI estimates the likelihood that submitted text, documents or images were generated by artificial intelligence. Results are probabilistic statistical estimates. They do not establish authorship and must not be used as the sole basis for academic, employment, disciplinary or legal decisions. Every result must be reviewed by a person with the surrounding context before any action is taken.
Scores may be wrong in both directions. Human writing can be flagged as AI-generated — particularly short samples, translated text, writing by non-native speakers, and templated or formulaic material — and AI writing can be scored as human. You are responsible for how you interpret and act on results.
4. Acceptable use
You must not:
- use the service for any unlawful purpose, or in breach of any applicable regulation;
- commit fraud, send spam, or misrepresent results as definitive proof of authorship;
- submit content you have no right to submit, or infringe anyone's intellectual property, privacy or confidentiality rights;
- interfere with the security or integrity of the service — including malware, probing, penetration testing without written consent, scraping, or circumventing rate limits, plan allowances or other technical restrictions;
- reverse engineer, resell or redistribute the service or its outputs as your own detector;
- use results to harass, defame or unfairly penalise an individual without independent evidence and a fair process.
You are responsible for maintaining the confidentiality of your credentials and API keys, and for all activity carried out under your account. You must provide accurate account information and keep it up to date.
5. Your content
You keep ownership of everything you submit. You grant us a limited licence to host, process, store and analyse that content solely to provide the service to you, to maintain security, and to meet legal obligations. Content is retained according to your workspace's retention setting and deleted automatically once that window passes.
6. Our intellectual property
We retain all rights in the TraceMark AI platform, including its software, detection models, scoring methodology, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the service within the plan you have selected, for the duration of your subscription.
7. Service level and warranties
We work to keep the service available and accurate, but we do not guarantee uninterrupted or error-free performance, nor any particular level of detection accuracy. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Payment, subscriptions and taxes
Paid plans are billed monthly or annually in advance, and renew automatically until cancelled. You can change or cancel your plan at any time from the Billing page in your dashboard; cancellation takes effect at the end of the period you have already paid for.
Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our Refund Policy sets out our money-back guarantee.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Suspension and termination
We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where it is reasonable to do so we will warn you first and give you a chance to put things right. You may close your account at any time.
On termination your access ends and your stored scans, results and reports are deleted after a 30-day export window, unless we are required to keep records by law.
10. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the fees you paid in the twelve months before the claim arose. We are not liable for indirect, consequential or special damages, including loss of profits, data, reputation or goodwill, or for decisions you take on the basis of a detection result. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
You will indemnify us against claims arising from content you submit, your unlawful use of the service, or your breach of these terms.
11. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email or in-app before they take effect. Continued use after that date means you accept the updated terms.
12. General
You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. If any clause is found unenforceable, the rest remain in force.
